1. About ClassShuffle
ClassShuffle is operated by Humbert Digital Products LLC. It is a teacher-facing tool for classroom grouping and seating charts. These Terms govern your use of ClassShuffle.
2. Accounts and Eligibility
Accounts are for teachers, educators, school staff and other adult education professionals aged 18 or older. Students and children must not create accounts. Provide accurate account information and protect your sign-in credentials.
3. Individual Account Use
Each account and subscription is for one individual educator. You may use your account on multiple devices, but may not share or resell account access.
4. Teacher-Managed Student Information
You may enter limited names or display names, grouping preferences, Keep Together and Keep Apart relationships, classroom placement needs, Readiness Levels, group assignments, saved groups and seating assignments. Ensure you are authorized to enter and use this information under applicable law and school policies. Humbert Digital Products LLC retains its own applicable responsibilities.
5. Student Information Limits
Do not enter unnecessary sensitive information, including Social Security numbers, home addresses, medical or counseling records, complete IEP or 504 documents, detailed disciplinary records, financial information or passwords. Placement needs and Readiness Levels do not require diagnoses or explanations.
6. Ownership of User-Provided Information
You retain ownership of information and content you enter. You give Humbert Digital Products LLC permission to process it only as reasonably necessary to provide, maintain, secure, troubleshoot and improve ClassShuffle and as described in our Privacy Policy. Student information is subject to the specific limits in that policy.
7. Intellectual Property
ClassShuffle software, source code, functionality, interface, designs, graphics, logo, branding, text and documentation belong to Humbert Digital Products LLC or its licensors and are protected by applicable intellectual property law. We grant you a limited, nonexclusive, nontransferable, revocable right to use ClassShuffle for your personal professional educational use under these Terms. Unauthorized copying, resale, sublicensing, source extraction, reverse engineering and derivative works are prohibited, except to the extent this restriction is prohibited by law.
8. Acceptable Use
Do not use ClassShuffle unlawfully, infringe others’ rights, upload malicious code, circumvent access controls or plan limits, access another person’s data without permission, or disrupt the service. Do not enter information you are not authorized to provide.
9. Free and Pro Plans
Free includes one class, one classroom layout and one seating chart, with core grouping functionality, grouping rules and classroom location needs. Pro includes unlimited classes, classroom layouts and seating charts, plus Readiness Level grouping. Unlimited means no product-plan count limit; reasonable technical and security safeguards still apply. Current plan details appear on the Pricing page.
10. Free Trials
An eligible educator may start a 14-day Pro trial with no credit card. The trial never automatically converts to a paid subscription. When it ends, the account returns to Free unless you intentionally purchase Pro.
11. Subscriptions and Billing
Current prices and billing frequencies appear on the Pricing page and at checkout. After you intentionally purchase a paid subscription, it renews automatically at the disclosed billing frequency until canceled. Stripe processes payments. Humbert Digital Products LLC does not directly store complete payment card information.
12. Cancellation
Cancel anytime through Manage Account to prevent the next renewal, with no cancellation fee. Your account and classroom information remain, and Pro access continues until the end of your current paid billing period unless you delete your account sooner.
13. Refunds
Payments are generally nonrefundable after a charge, except where required by law, for duplicate or erroneous charges, or in other circumstances Humbert Digital Products LLC determines appropriate. Contact support about a billing problem. These Terms do not limit legally non-waivable consumer rights.
14. What Happens When Pro Ends
Subscription or trial expiration alone does not automatically delete classes, layouts, seating charts or Readiness Level values. Information may remain stored above Free limits. Free accounts with multiple classes must choose an active class; other saved classes remain stored. Creation, editing or Pro-only features may be restricted until you come within Free limits or restore Pro.
15. Changes to Pricing
We may change pricing without a lifetime price guarantee. Changes do not alter charges or billing periods already paid. Existing subscribers will receive reasonable advance notice before a different price applies to renewal.
16. Changes to ClassShuffle
We may add, change or remove functionality as the service evolves. We will make reasonable efforts not to unnecessarily interfere with existing classroom information.
17. Suspension and Termination
We may suspend or terminate access for Terms violations, security risks, fraud, unlawful activity or significant operational or legal risk. We will provide advance notice where reasonably practical, but may act immediately for urgent security or fraud issues.
18. Account Deletion and Data
You may delete supported classroom information or permanently delete your account through Manage Account. Account deletion stops future subscription renewals and ends access, then removes account and classroom information from active systems. If billing cancellation cannot be verified, deletion stops and reports an error. Temporary backups and legitimate legal, accounting and security records may remain as described in the Privacy Policy. Deletion may not be recoverable and does not itself entitle you to a refund.
19. Third-Party Services
ClassShuffle uses service providers for authentication, hosting, data storage, payments and support. Their services may also be subject to their terms and policies. Our Privacy Policy describes the providers and information involved.
20. Service Availability
We do not guarantee uninterrupted or error-free service. Maintenance, outages, security measures and circumstances beyond our control may affect availability.
21. Classroom Decisions
Teachers are responsible for reviewing groups, seating charts and classroom arrangements before use. ClassShuffle assists educator judgment and does not replace it.
22. Disclaimer of Warranties
To the maximum extent permitted by applicable law, ClassShuffle is provided as is and as available, without express or implied warranties, including merchantability, fitness for a particular purpose and noninfringement. This does not exclude warranties or rights that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent allowed by applicable law, Humbert Digital Products LLC and its licensors will not be liable for indirect, incidental, special, consequential or punitive damages or lost profits arising from use of ClassShuffle. Our total liability will not exceed the greater of the amount you paid ClassShuffle during the 12 months preceding the event giving rise to the claim or $25. Nothing limits liability or consumer rights that legally cannot be limited.
24. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Please contact us first so we can try to resolve a dispute informally. Applicable non-waivable consumer protections and jurisdiction or forum rights remain in effect. These Terms do not require arbitration or waive class-action rights.
25. Changes to These Terms
We will provide reasonable notice of material changes through the app, email or another appropriate method. Minor edits need not receive individual notification. Changes do not retroactively alter already-paid charges. The updated date identifies the current version.
26. Severability
If a provision is unenforceable, the remaining provisions continue in effect to the extent permitted by law.
27. Entire Agreement
These Terms and the policies and purchase terms incorporated here constitute the agreement regarding your use of ClassShuffle, subject to applicable non-waivable rights.
